Curious Minds Software, LLC ("Company," "we," "us," "our") offers Curious.ai ("App"), a subscription-based learning application utilizing generative artificial intelligence. This document, the "Terms of Service" ("Terms"), outlines the conditions and rules that govern your use of our App.

Your acceptance of these Terms creates a binding legal agreement between you and the Company, so please read them carefully. If you do not agree with these Terms, you should not access or use the App.

1. ACCEPTANCE OF TERMS

By installing, accessing, or using the App, you acknowledge that you have read, understood, and agreed to these Terms. If you do not agree to these Terms, you must immediately uninstall the App and discontinue its use.

2. PRIVACY

Your privacy is important to us. Please review our Privacy Policy, which explains how we collect, use, and protect your personal data. The Privacy Policy is incorporated into these Terms by reference.

3. ELIGIBILITY

To use the App, you must be at least 13 years old or the minimum legal age to consent to the processing of personal data in your jurisdiction, whichever is higher.

4. ACCOUNTS

You are responsible for safeguarding the confidentiality of your account credentials. You agree to promptly notify us of any unauthorized use of your account.

5. USE OF THE APP

You agree to use the App in compliance with all applicable laws, rules, and regulations. You are prohibited from using the App for illegal, harmful, misleading, or fraudulent activities. Any misuse of the App that violates these Terms may result in immediate termination of your access to the App.

6. INTELLECTUAL PROPERTY

The App, including its text, graphics, images, and other content, is the property of the Company and is protected by copyright, trademark, and other laws. You are granted a limited, non-exclusive, non-transferable license to access and use the App for your personal, non-commercial use.

7. USER CONTENT

When you upload, share, or otherwise provide content to the App, you retain your rights to that content. However, by providing content, you grant us a worldwide, non-exclusive, royalty-free license to use, copy, reproduce, process, adapt, modify, publish, transmit, display, and distribute such content.

8. LIABILITY, INDEMNITY AND CONTENT MODERATION

While we strive to foster a safe and accurate learning environment, the Company cannot guarantee the validity or reliability of the content generated by the App or shared by users. We take steps to monitor and remove content that violates our Terms, is reported to be factually incorrect, or promotes hate, violence, or harmful information. However, we do not undertake to review all content and are not responsible for the accuracy or legality of information provided by users or the artificial intelligence.

You agree to indemnify and hold harmless the Company, its affiliates, officers, directors, employees, agents, and licensors from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses, resulting from or arising out of a) your use and access of the App, by you or any person using your account and password; b) a breach of these Terms; or c) content posted on the App.

In no event shall the Company, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of or inability to access or use the App.

Your use of the App is at your sole risk. The App is provided on an "AS IS" and "AS AVAILABLE" basis. The App is provided without warranties of any kind, whether express or implied.

This provision does not affect your statutory rights as a consumer, and does not exclude or limit our liability for fraud, fraudulent misrepresentation, death or personal injury caused by our negligence, and, if required by applicable law, gross negligence.

9. GOVERNING LAW AND JURISDICTION

These Terms and your use of the App will be governed by the laws of the State of California, without regard to its conflict of laws principles.

10. GDPR, CCPA, AND OTHER APPLICABLE LAWS

We comply with the General Data Protection Regulation (GDPR), the California Consumer Privacy Act (CCPA), and all other applicable laws regarding data protection and privacy. For more information, please refer to our Privacy Policy.

11. MODIFICATIONS TO TERMS

We reserve the right to modify these Terms at any time. If we make changes, we will notify you by revising the date at the top of the policy.
